New York fines company $1.3M for selling NRA-branded 'self-defense' insurance

Chubb Ltd. and a subsidiary have agreed to pay a $1.3 million fine for unlawfully selling National Rifle Association-branded "self-defense" liability insurance to gun owners in New York.

The New York State Department of Financial Services said Chubb and its subsidiary, Illinois Union Insurance Co., sold "Carry Guard" liability insurance that would cover gun owners even for acts of intentional wrongdoing, and improperly provided legal services insurance for gun owners and their family members who may be charged with a crime involving a legally possessed firearm.

Chubb, the world's largest publicly-traded property and casualty insurance property, sold the insurance through Lockton Affinity.

Lockton is licensed to sell insurance in New York, but the NRA is not ...

... The settlement follows an investigation by the New York State Department of Financial Services (NYDFS), which found that the NRA’s “Carry Guard” insurance program “unlawfully provided liability insurance to gun owners for acts of intentional wrongdoing,” the regulator said in a statement.

The insurance, underwritten by Chubb unit Illinois Union Insurance Company, also “improperly provided” legal services for policyholders who faced criminal charges after using their guns in self defense, the regulator said ...

In addition to the fine, Illinois Union agreed not to participate in the Carry Guard insurance program, or any similar program in New York, nor to provide Carry Guard or similar policies to New York residents, regardless of where they are written, the DFS said ...

The National Rifle Association has sued an affiliate of Kansas City-based Lockton Cos., accusing the insurance broker of breaching its fiduciary duty to the gun rights organization when it announced earlier this year that it would drop services to an NRA-branded insurance line ...

Lockton Affinity was the broker and administrator of NRA Carry Guard, an insurance product marketed to NRA members. Carry Guard offers coverage for civil and criminal legal defense, bail, psychological support and clean up costs associated with "the use of a legally possessed firearm — including an act of self-defense."

Lockton Affinity announced in February that it would discontinue the relationship with the NRA. The announcement came nearly two weeks after a Feb. 14 shooting at Marjory Stoneman Douglas High School ...

The NRA's lawsuit comes days after Lockton Cos. agreed to pay a $7 million fine to the New York Department of Financial Services for violating New York insurance laws through its administration of NRA Carry Guard ...


UK insurance company terminates programs available through NRA

NY Regulator Fines Insurers, Broker Over NRA-Branded Gun Owner Liability Policies

The New York Department of Financial Services has fined an insurance broker, Lockton Affinity, $7 million in connection with sales of a National Rifle Association-branded “Carry Guard” insurance program and similar products for gun owners, and also separately fined a subsidiary of Chubb Group Holdings $1.3 million for underwriting the same type of insurance, as part of consent orders with the companies.

Financial Services Superintendent Maria Vullo said in a statement earlier this week the actions followed a DFS probe, which found that the NRA “Carry Guard” program sold by the Chubb subsidiary Illinois Union and broker Lockton Affinity provided liability insurance to gun owners and resident family members for legal costs connected with criminal defense for using a legally owned firearm, violating state law. Lockton Affinity is licensed as an excess lines insurer in New York. The NRA is not licensed to operate as a business in New York state, DFS said.

Vullo said, “DFS will not tolerate conduct by any entity, licensed or otherwise, in contravention of New York Insurance Law, especially when that conduct is such an egregious violation of public policy designed to protect all citizens” ...


NRA Sues New York, Says State `Blacklisted Campaign’

It says that clearly right on their policy. The coverage is voided if one either admits to guilt or is found guilty.
