3. When I saw some of the Facebook ads

 

paid for by Russians I was confused. They did not seem very harmful.

But hearing Rachel tonight I get it.

An ad praising Hillary for supporting BLM was only aired in red districts.

There had to be coordination for that to work.

my understanding, however, is that there is not. Once the results are certified in the Electoral College, it's irreversible. The best hope is to impeach and convict Trump and Pence. The most realistic hope is to batter the Republicans in the midterms and take back Congress.

Our election process has been manipulated by a foreign government in combination with illegal activity by the campaign and the party of the winning candidate. Seems to me that is situation where the SCOTUS needs to get involved.

72. Unfortunately the time for that has long since passed.

 

Individual legal actions contesting election results can and do sometimes make their way up to SCOTUS. However, once a President is elected by the Electoral College, it's game over vis-a-vis reversing or changing the result. There simply isn't any constitutional mechanism for a new election or "do-over" as you and others put it.

Other remedies are, however, still on the table. These remedies would all involve removing Trump, then hopefully Pence, according to rules of succession. There isn't a mechanism for making HRC President unless she were to be named Speaker of the House, coupled with the removal of both Trump and Pence. This is something the Democrats COULD, in fact, do if they take over the House in November. Realistically, though, it's exceedingly unlikely that anyone other than Nancy Pelosi will be Speaker if the Democrats get the House.

The framers gave the Electoral College broad discretion to resolve disputes as it saw fit: The text of the Constitution pretty much says an election is legitimate when the Electoral College says it is. It doesn’t lay out a process for do-overs. Occasionally, courts have ordered new elections for offices other than the presidency after a proven case of fraud or error. (Or gerrymandering — a court in North Carolina ordered new state legislative elections, though this order has been put on hold.) And a Senate election was once redone in New Hampshire because it was too close to determine even with multiple recounts.

But whether this kind of re-do is allowed for presidential elections is a more complicated matter. Some legal scholars maintain that the language in Article II of the Constitution prevents holding a presidential election again, thus putting it beyond the power of the courts to order a re-vote, as they have occasionally done for other offices. Others suggest that there is legal precedent for a presidential re-vote if there were flaws in the process. One instance in which this question arose was the “butterfly ballot” from the 2000 election, which may have caused some voters to choose Pat Buchanan when they meant to vote for Al Gore in Palm Beach County, Florida.

If the 2000 election had taken some different twists and turns, the re-vote question might have come up in a serious way, and it’s not clear what the courts would have decided. At least one federal court has suggested that the courts could order a new election. In 1976, a District Court in New York heard a case alleging voter fraud in several urban locations. The court’s opinion maintained that federal courts had a role to play in ensuring free and fair presidential elections, arguing: “It is difficult to imagine a more damaging blow to public confidence in the electoral process than the election of a President whose margin of victory was provided by fraudulent registration or voting, ballot-stuffing or other illegal means.” This assertion challenged the idea that presidential elections occupy a special category beyond such court remedies. However, in this case, the court didn’t find sufficient evidence that voter fraud had altered the outcome, or even occurred at all. As a result, its claims about presidential elections were not evaluated by higher courts and have never really been tested.

So experts disagree about whether courts can order presidential elections to be held again. That’s not great news for angry people hoping for a do-over. And even if it is constitutionally permissible, there’s much broader agreement that the standard for invalidating an election result and holding another vote is quite high. University of Memphis law professor Steven Mulroy told me that courts will usually entertain this option only if they determine a violation of rules that would change the election outcome. In the case of the 2016 election, this would likely require proving tampering in several states where the vote was close — enough to change the result in the Electoral College. In that case, a few states would vote again, not the entire country, Mulroy said. But this is new territory, and no one knows for sure.

I post on a conservative forum from time to time and those guys are totally bat-shit crazy. They buy everything fox tells them and the say that the rest of the media is all part of the “deep state”. Yet, at the same time they are saying that democrats were able to create this intricate deepstate under the noses of republicans, that democrats are stupid and inept and can’t even manage an email server properly. Democrats are stupid for believing that there might be s trump-Russia connection while they are simultaneously believing that the deepstate thing is a hoax.

Sorry, but the party that actually believed the conspiracies of pizzagate, climategate, that school shootings are staged by democrats, and the illimati is totally nuts. The basis of their beliefs is that everyone is after them - including the government - and they have too keep their guns and their survivalist bunkers stocked for Armageddon. Never mind that the government that is supposedly after them has been dominated by the republicans at the state and federal level since 1980...

Come on Rachel, we aren’t ignorant Fox viewers, probably a majority of her audience is aware of who Clapper is and his experience. We don’t need to be spoon fed every little detail, over and over. It is exasperating but, by the same token, I will always love you Rachel. Chris Hayes got a little talky today too trying to explain the Broidy affair which is truly confusing. He was all over the place. Just say, Trump impregnated the woman who was paid 1.6 million by Broidy who took the fall for for the affair for Trump In return for millions in government and foreign contracts. A form of bribery for which Trump will be indicted.

non-biased Committee called the House Intelligence Committee. They will use the opportunity to try and discredit his claims and probably even make some ridiculous charges against him such as dereliction of duty, to try and destroy his character. They don't want the truth, they just want to ask a bunch of misleading leading questions like Gowdy would do with Hillary, "such as the infamous "Do you still beat your wife, Mr. Clapper?" and when he tries to respond "Just Yes or No" Mr Clapper, I don't have a lot of time, and I've got lots more misleading questions I want to get to."
