No American president has ever been jailed due to, -- not our legal system, -- but our political one.
Were Trump to be jailed, imagine what would happen to the next Democratic president. Republicans would be shrieking from day one that the new president is a criminal and must be locked up. They would make up "crimes" and use their echo chamber to repeat, repeat, repeat. After all, when Trump leaves the White House, Fox "news," and the entire wingnut hate machine, will still be around peddling their snake oil. And you can bet that snake oil will be more poisonous than ever. (My fear is that this might happen regardless of what happens to Trump.)
Nonetheless, a government controlled by the Democrats would understand that if they tried to push the prosecution and imprisonment of Trump, they would only be adding fuel to our ongoing civil war. They would drop the matter.
Unfortunately, the same can't be said of the Republicans. If a government controlled by Democrats had pulled a small fraction of the crap that Trump and the Republicans have, the revenge and imprisonments would be never ending.
Anyhow, don't hold your breathe waiting for Trump to go to jail. The best we can hope for is that he'll go to Moscow and stay there.

The main reason I don't think he'll ever be jailed is that it would be impossible to impanel a jury in this country that would not have a a few white wingers who'll see this as a "political witch hunt."
I doubt he will even be impeached, much less convicted by Senate.
Some of his aides and maybe a kid or two will be indicted, but they too might be hard to convict. I would personally enjoy his kids and Kush taking a fall and being ruined, but they'd still have a chance with likely juries to avoid imprisonment.
Impeachment or indictment would be satisfying for us short-term (me too), but you are right that it would set off, or worsen, an on-going political "civil war" wave that would likely be worse than what we have now.

I don't care if he tweets from his room in Mar-a-Lago. I just want him out of Washington.

(2,785 posts)department of justice guidelines, but I've never heard that an ex-President cannot be indicted. If our position is Trump shouldn't not be indicted or jailed because of how republicans would react to it than we should should stop claiming no one is above the law and we should never so much as allow an investigation into a sitting President ever again because the whole process would be absolutely worthless.

(5,518 posts)But investigations are still worth it because there are other ways that they can come to resolution. Nixon is an example of a result that did not involve an indictment. Frankly, I would accept a resignation in shame as a win.

(5,518 posts)But it would still be better than him winning re-election. The investigation and the crimes it brings to light could be the difference.
It would be a travesty but we press for justice to get as far as we can in restoring order. In a just world, the perpetrators would be jailed. We don't live in a just world.
If it were me, I would be looking for the political equivalent of a plea deal. Leave now in shame and you wont get prosecuted. It isn't fair but would be the fastest way to start over rather than a long drawn out battle.

How do you get a "jury of peers" for the "most powerful person in the world". Is there any person in the US that would actually be independent enough to sit on a jury?
Any judge would be considered tainted by whichever part nominated them. How do you handle appeals when some of the judges are appointed by him?
What a mess. Our Government is not prepared for this. Just send him away in shame and start to work on the repairs. I know it sucks but I just don't see it working any other way.

(15,027 posts)Firing Comey. Telling Russians in the Oval Office that he had the "collusion thing" off his back. Humiliating Sessions because he wouldn't "protect" him.
There are many public instances of his obstructing justice.
As for the other "possible" crimes Trump committed, the government had to settle for getting Al Capone on income tax evasion. Is there anyone who didn't understand that Capone was guilty of murder and virtually every other crime on the books?
Trump's business ties to Russia, (and outright money laundering), are obvious to anyone who cares to look into Trump's track record.

(14,624 posts)I would be okay with Dump not doing time as long as he has to forfeit all assets so that he dies a penniless, insignificant, shell of a human being.
But I want to see his 3 oldest children and Kushner in prison.
