They have to. The hiring process for SC clerks starts at least a year in advance. If a retiring Justice didn't hire clerks the new Justice would have to scrabble at the last minute. Not the way it is ever done.

I think Trump is just so corrupt, and the people he does business with so venal, that almost everything he's involved with, from his awful product launches to his marriages, are indubitably tainted.

So yeah, really, if he can figure out how to benefit materially from appointing judges, he will. I bet he'll soon be actually selling judgeships and pardons too.

Kennedy might be just retiring, but he probably should address the issue of his son's connection to the Kushners.
