does not make the communication privileged. Cohen was not working as Trump's attorney in these conversations. He was acting in a non-legal capacity as Trump's fixer.

A Special Master appointed by the judge to decide which materials seized by the FBI decided what documents/recordings were subject to attorney-client priviledge. Note

1. It is unknown how many recordings were labelled privileged.

2. Trumps attorneys waived privilege on 12 recordings - meaning they will not fight against the use of those tapes in any legal proceeding. There may be more still protected.

3. There may be more that the Special Master deemed NOT privileged.

4. In this case the investigators share the materials with the prosecutors. The prosecutors will decide what they want to use as evidence if/when they bring charges against Cohen or anyone else.

5. Only when the material is filed as evidence after charges are laid will anyone know exactly what the DOJ is sitting on.
