9th Circuit rules that the 2nd Amendment protects open carry.

Interesting ruling today.

A federal appeals court ruled Tuesday that the 2nd Amendment protects the right to openly carry a gun in public for self-defense.

The 9th U.S. Circuit Court of Appeals ruled 2-1 that Hawaiian officials had violated George Young's rights when he was denied a permit to openly carry a loaded gun in public to protect himself.

If the legal consensus were to be that open carry is not allowed, it would not be allowed. The (Russian money taking) NRA spends a lot to influence politicians and gun owners.

Legal consensus at one time pointed to slavery as being legal. That consensus evolved. Slavery is no longer legal.

This might undergo additional review by the full appeals court. The 9th is usually the most liberal in the country.

of course they hear more cases than any of the other circuits as well. Was there supposed to be a point to your comment? The thing is it manages to be meaningless yet sound accusatory.

But that decision would not likely survive if SCOTUS takes it up. For that reason, the 9th may just sit on this one, to avoid risking this going to SCOTUS and setting national precedent. If they overturn this En Banc, its pretty much guaranteed to be appealed to SCOTUS, by which point Kavanaugh will already have been seated. If any gun case gets to SCOTUS after Kavanaugh is seated, it will be 5-4 siding with the guns.

You're right that this was a 3 judge panel.

11 of the 29 would be used in an en banc review.

I think they're authorized 29 judges... but there are several vacancies (which are offset by over a dozen judges with "senior status" who still hear cases).

But I would get a bit nervous seeing gun toting civilians around town here in Chicagoland. I understand that is just my opinion, but if the second amendment is interpreted that everyone has the right to have a gun with them any time and anywhere, I do not see why that needs to be open carry?
