Do we have a prison suitable for holding a former pResident?
I'd imagine that he would have to be in isolation...
Does he lose Secret Service protection if convicted?

10. Spandau prison was pretty secure
Though I think that was mostly due to the Soviets, who really knew how to lock up people. I don't think we can call on their expertise in this situation.

13. it would take a miracle to get to that point, but if we did, it would be home confinement at best.
i really can't see a scenario where he ends up in a real prison.
even if he's dead-to-rights on multiple felonies that pre-date and have nothing to do with his presidential campaign. |

Now, I’d love that. But reality is, it’s not happening. Like, there’s a zero percent chance that he will ever be behind bars.

19. yeah i don't think they're thinking all the way through.
i think there's a fair chance that he'll actually stand trial (most likely post-presidency) and accept a plea deal that includes home confinement.
actually being behind bars? i don't think he'd accept any such plea, so that means a trial. lots of uncertainty and lots of delays. he can delay a *lot* while president, even if the supreme court eventually says a president can be tried while still president. he can always claim important business to interfere with the court schedule. maybe he gets impeached in 2019, but even so, the trial might not start until 2020. if not it might easily be 2021. once he's out of office, it serves him to play up adverse medical conditions. he'd old, out of shape, and gosh being president takes a toll. when it comes to negotiating, staying out of prison is probably the top priority, so a plea that gives him home confinement is likely a "win" for donnie and any guilty plea is a "win" for prosecutors as well. keep in mind his remaining life expectancy is around 9 years, so big delays and playing up medical conditions make for a good argument against him going to actual prison. |

Whether it's likely is another matter. There are still a lot of hoops and contingencies--Trump getting indicted, Trump getting convicted, Trump not getting the benefit of a Ford-esqe pardon, Trump getting sentenced to incarceration, Trump not keeling over of a heart attack before it's all said and done, etc.
It's just too early to say how likely that will all play out. It's unprecedented here, but we've only had 45 presidencies to date so lots of things that happen with any president might be considered unprecedented. Before 1974, it was unprecedented that a President had ever voluntarily resigned his office, for example. But if you want to look for a fully developed, democratic country that has just recently sent its former leader away to prison, look no further than South Korea. Just as an example. There are some things that are frequently bandied around here at DU that are simply not going to happen. Like nullifying the 2016 election and installing Hillary. Love it, but it's not going to happen. Or nullifying all judges that Trump appoints. Again, not going to happen. But the idea that Trump could potentially face prison time, while still a long ways off and extremely speculative at the moment, is an actual possibility. |
