DonaldTrump asks judge to dismiss NY AG lawsuit over Trump Fdn., b/c former AG Schneiderman criticized Trump, and didn't do enough to investigate the Clinton Fdn.
(tho Schneiderman didn't file the suit -- he resigned before it was filed).

Any lawyers out there? This is a NY state lawsuit and Trump can't do anything to get it shut down - is that correct?

In non legal terms, the question is:
"did Trump use the Trump foundation as his personal piggy bank to serve Trump's business or political interests or not?"

the answer to that question has nothing to do with the Clinton Foundation or the prior AG's criticism of Trump.

David Fahrenthold, a Harvard grad and Washington Post reporter won a Pulitzer Prize for National Reporting largely on his look into the Trump Foundation and claims of charity. Trump might have whined about that being "fake news" but the court will find as they always do that facts are stubborn things.

I’m sure what you mean by that question.

Can he file a motion to dismiss? Yes. That’s a normal step in any legal proceeding, and it would be malpractice if his lawyers didn’t do so. Obviously, judging that motion by one “throw it against the wall and see if it sticks” argument chosen for amusement is not how the motion will be decided.
