(53,061 posts)In normal times I would assume it would go to the non political part of the DOJ for a decision, like they did on Menendez.
The other possibility would be prosecuting by the state on the sexual assault charges of which Mendez may be the stronger case.

Im incensed by all of this but its maybe better than a second Gorsuch who really will be there for life.

(7,901 posts)and then refer the evidence to the FBI for indictment and prosecution. The FBI cannot refuse to prosecute. The House has it's own Judiciary Commitee and has the statutory right to do it. You can't hear cases in a federal corrections institution.

(12,344 posts)DOJ makes its own judgement as to what is worth prosecuting.
But the SOL for perjury is 5 years, so if a Dem wins in 2020, Kavanaugh may be in trouble.
