"He wanted it." Ex-coach's wife: Teen football player agreed to sex to stay in her home

KNOXVILLE, Tenn. — He wanted it.

That’s what the wife of a former high school football coach says about the teenage boy she lured into her marital bed after her husband invited him into their home, court records show.

Kelsey McCarter, 29, is asking a Knox County (Tenn.) Circuit Court judge to toss out a lawsuit filed against her and her husband — then South-Doyle High School assistant football coach Justin McCarter — by a 14-year-old boy who says she repeatedly molested him after he moved in with the couple.

She is currently behind bars after pleading guilty in Knox County Criminal Court in 2017 to a half-dozen statutory rape charges involving the boy. But she insists, via attorney Doug Trant, she’s no rapist or child molester, and the boy’s lawsuit for damages should be dismissed.

She's already in jail on the criminal charges.

This article is not about the criminal charges.

This article is about a civil lawsuit brought by the boy, presumably on a theory of battery, in which consent does matter.

It is not "allowed". Having sex with a 14 year old is why she is in jail.

Whether something is "allowed" is the function of criminal law. A number of people commenting in this thread appear not to understand that she has pleaded guilty, and is in jail.

The article does not link to the specific pleadings in the civil lawsuit, so we are left to guess what theory might be claimed by the plaintiff to the effect that this woman owes this child a sum of money.

I have not dealt with that in a while. By now some states might have strict liability tort law on that.

... oh, and get laid, sure.

But here's the thing ... you're supposed to be 'an adult'.

And as an adult, particularly one in a position of authority as you were here, it's your responsibility to NOT give dumb (by their inherent nature) 14 year old boys 'things that they WANT, but not should not be having' ... which would include, but not be limited to ... pot, beer, the keys to your car, your BODY, etc.

I could see maybe if the kid was 17, arguing that 'damages' aren't rightly called for, and that jail 'should be enough' ... but if the sex started at 14, lady? Sorry, but you ain't got a leg to stand on here.

Time to pay up!

By the way the 'he wanted it', part? That was already 'figured in' ... when you got your statutory rape beef, instead of one for outright rape, which carries significantly more jail time.

May wanna keep that in mind!
