(62,444 posts)It's fascinating how people want to go after the judge for accepting the deal which the prosecutor proposed, but nobody wants to talk about the prosecutor.

While outrage over that decision ripples across the country, both LaBorde and her boss have defended her action. Meanwhile, Anderson's attorneys have told local media that the accuser has given multiple inconsistent statements.
A letter from LaBorde to the victim and her parents shows the prosecutor was worried that jurors would end up blaming the victim and that Anderson might not be convicted because he's only accused in one sexual assault case.
"It's my opinion that our jurors aren't ready to blame rapists and not victims when there isn't concrete proof of more than one victim," the prosecutor wrote.
Here are excerpts from LaBorde's letter, sent after she accepted a plea agreement from Anderson's defense team:

The victim, who has been outspoken against the plea bargain, began to cry loudly Monday after Strother announced his decision to accept it. She urged the judge to reject the plea offer and set a trial so she could have her day in court. She said Anderson sexually assaulted her, repeatedly choked her and left her for dead after she fell unconscious.
Later, in an emotional victim impact statement, she told Strother she is devastated that he approved the plea bargain. She called out prosecutor Hilary LaBorde, who struck the deal with Anderson, and McLennan County District Attorney Abel Reyna for not attending the hearing.

Not too terribly difficult to understand. Not too damned mysterious either unless you force it to be.

but of course, you are the only one making that argument. That's seems the "real head-scratcher..." No more merit badges available for self-righteousness this month.

Clearly you didn't read the links I posted, which include the victim's statement. Yeah, sure, I'm the only one making that argument here, because it seems practically no one else bothered to find out what the victim had to say.
The judge was NOT presented with choices. The judge was presented with a prosecutor who did not want to prosecute the case. Period.
Do you have something else to add in order to excuse the deal the prosecutor made here, or are you just here to talk about your fascination with me personally?

Isn't that kind of the point, though?
Numerous people are calling out the judge for accepting the plea deal, while almost no one is looking at the prosecutor who CAME UP with the deal? That seems downright odd to me.
Not too damned mysterious either unless you force it to be.
It seems mysterious as hell to me. No force required.

I've never been uncomfortable to be the only one making an argument, though. It's a risk you take when you think for yourself.

The prosecutor didn't think she could win and was certain the defense would flip it and put the woman on trial, dragging her through hell.
Although they totally blew it by not informing the woman beforehand, if memory serves me, they honestly felt this was the better decision give the laws as they are today.
Please do not take a face value everything you see in your first few seconds with a piece of news.
