(42,759 posts)Chiefs of staffs are not immune from being called to testify. They aren't because the president would claim executive privilege and shut it down.
Mulvaney can be called to testify about OMB matters but if he was asked to testify about his dealings with the president as Chief of Staff, executive privilege could (and almost certainly would be) invoked.
In fact, rather than a blunder, one could view this as a smart move, since it makes it easier to invoke executive privilege with respect to OMB matters.
