The old idea of war is obsolete. Putin knows it.

I am less sure than he that a "declared war" is a condition precedent.

However, I think the question unnecessary. We can get where we need to go with more conventional charges.

Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort.

6. Some still insist an enemy can only be the object of a declared war. This is just plain obsolete.

It fails on the first part. But fits the second part for treason.
