LANSING – There was a “possibility” of bringing a conspiracy to commit perjury charge against House Speaker Jase Bolger and state Rep. Roy Schmidt over their recruitment of a fake Democratic candidate, but the case would have likely taken too long to investigate and been too difficult to prosecute, Kent County Prosecutor William Forsyth said today.

A Michigan State Police detective believed further investigation could have led to a perjury conspiracy case being brought against the two politicians, the Free Press reported exclusively this morning.

Forsyth said in a telephone interview that one of the most significant factors in him shutting down the MSP investigation on July 17 was the need to tell voters before the Aug. 7 primary what had happened. Schmidt of Grand Rapids faced write-in challenges after jumping from the Democrats to the Republicans on May 15, just before the filing deadline.

The State Police detective leading the investigation believed Bolger, R-Marshall, and Schmidt could have been charged with the felony of conspiring to commit perjury if they knew fake Democratic candidate Matt Mojzak was not living at a home in Schmidt’s district. Mojzak had falsely sworn in his affidavit of candidacy that he was living on Woodpath in Grand Rapids.

Schmidt switched parties just before the filing deadline, just as Mojzak filed as a patsy Democratic candidate. Papers for both of them were delivered to the Kent County clerk by Phil Browne, a top aide to Bolger. Having Mojzak on the ballot as a Democrat would have made it more difficult for Democrats to mount a write-in challenge, had Mojzak not withdrawn on May 18 amid a media furor over the fact he didn’t live in the district.

Forsyth's July 17 report, announcing he would not charge Schmidt and Bolger with a crime, contained shocking details about the depth and coordination between Schmidt and the top GOP House leader to make Schmidt a Republican and ensure his easy re-election with a patsy opponent. He originally filed as a Democrat but switched to the GOP shortly afterward.

Text messages obtained by the state police showed how Schmidt's son and nephew then recruited a 22-year-old friend, Matthew Mojzak, to be Roy Schmidt's fake Democrat and how Bolger played an active role in advising Schmidt to hand-pick a stand-in opponent. Mojzak, who was initially offered $500 to be Schmidt's opponent, withdrew from the race after news organizations questioned his Ottawa County residency and Schmidt offered him $1,000 to stay in the race.

Forsyth concluded no crime was committed by Schmidt and Bolger. But he likened the attempted election rigging to fixing a professional boxing matchup.

Democrats have called for Forsyth to reopen the probe after the Michigan State Police released records last week detailing how Forsyth ended the investigation before additional search warrants were carried out for Schmidt and Bolger's text messages and emails.

Ex-Democratic Party official jailed for fake Tea Party scheme

Pontiac— The former political director of the Oakland County Democratic Party was sentenced Wednesday to 30 days in jail for his role in putting bogus candidates on the ballot in 2010 under the banner of a fake Tea Party.

Jason Bauer, 28, was sentenced by Oakland Circuit Judge James Alexander to the jail time, one year's probation and more than $2,500 in fines and costs. Bauer had pleaded no contest to five counts of fraud for creating the fake political party to confuse voters and manipulate the 2010 election.

Bauer and Michael McGuinness, former county party chairman, were both charged in a scheme in which fake candidates were added to the ballot in an effort to sway votes away from legitimate candidates for local and state offices.

McGuinness was sentenced last month to one year's probation and court costs and fines for his role in the scheme.

“This is as heinous as someone who tries to kill somebody else,” Alexander said.
