The JUDGE who sentenced Ethel and Julius Rosenberg called them traitors even though they were found guilty of espionage, not treason. Likewise, this act of betraying the US should be called treason even if it doesnt fit the exact crime definition of treason.

(13,569 posts)under Section 2 of the Espionage Act of 1917, 50 U.S. Code 32 (now 18 U.S. Code 794), which prohibits transmitting or attempting to transmit to a foreign government information "relating to the national defense".
You can call their acts whatever you want. So can the judge.
They were convicted of Espionage.

Selling out your country is regularly called treasoneven if the specific crime is espionage, or conspiracy against the United States.

(11,098 posts)I could make the argument that Russia' cyber-attack was an act of war and that providing "aid and comfort" to Russia in that attack amounts to treason. The problem is that the law is not clear and the same result can be obtained by charging conspiracy against the US.
I was taught by a judge years ago not to plead what I don't have to prove.
