If he doesn't resign by Monday, Democrat Patrick Hope will introduce the articles of impeachment, which he already requested to be drafted.
After lawmakers in the Virginia Capitol had dodged reporters for days when asked about Tyson's allegations, at least one state delegate -- Patrick Hope of Arlington -- told CNN on Friday that he has begun the process of drafting articles of impeachment against Fairfax and is prepared to introduce them on Monday if the lieutenant governor does not resign before then.
Hope said he believes that Fairfax should and will resign before then but, if he doesn't, he has asked the legislative services to begin drafting the articles of impeachment to be introduced on Monday morning.

(17,427 posts)The impeachment proceedings are the due process. The House of Delegates investigates and decides if the merits of the case should send it to the Senate. It can't send him to the "slammer."
It takes a super majority to impeach, convict and remove from office. Perhaps an oversimplification, but the House is like a Grand Jury and the Senate is like a court.
Article IV. Legislature
Section 17. Impeachment
The Governor, Lieutenant Governor, Attorney General, judges, members of the State Corporation Commission, and all officers appointed by the Governor or elected by the General Assembly, offending against the Commonwealth by malfeasance in office, corruption, neglect of duty, or other high crime or misdemeanor may be impeached by the House of Delegates and prosecuted before the Senate, which shall have the sole power to try impeachments. When sitting for that purpose, the senators shall be on oath or affirmation, and no person shall be convicted without the concurrence of two-thirds of the senators present. Judgment in case of impeachment shall not extend further than removal from office and disqualification to hold and enjoy any office of honor, trust, or profit under the Commonwealth; but the person convicted shall nevertheless be subject to indictment, trial, judgment, and punishment according to law. The Senate may sit during the recess of the General Assembly for the trial of impeachments.
