Bartender charged after serving intoxicated mass shooter

A bartender in Texas was charged with a misdemeanor after serving an intoxicated man who later shot and killed eight people, including his estranged wife.

Lindsey Glass, 27, served Spencer Hight multiple drinks on Sept. 10, 2017, at Local Public House in Plano. According to reports, Hight had two gin and tonics, a shot of vodka, and two beers. While at the bar, he took out a large knife and spun it around on the counter-top and talked about "taking care of some dirty work."

"Hight was unsteady on his feet and staggered around the bar, running into tables and walking sideways," according to a report.

Glass was alarmed enough to text a co-worker about it, but nevertheless served him.

Hight left the bar and murdered eight people at his wife's home. Police shot and killed him at the scene.

Glass was charged for allegedly violating a Texas Alcoholic Beverage Code titled "Sale to Certain Persons."

I understand what they are trying to do but quite frankly if we are going to make the argument that bartenders should not serve drinks to drunk patrons than we might as well close all bars throughout the United States

I am not defending the actions of the disgusting vile murderer but there is no way for a bartender to know. Further, people go to bars to drink and sometimes that involves getting drunk. There is no way for a bartender to know when someone has had one too many. There are simply too many variables and it is entirely subjective

Yes there are many borderline cases, but there are also times when it is really obvious.

I'd imagine most convictions are closer to the really obvious end of the spectrum.

to drink before they even step foot into the bar.

A weird thing I've seen many times is some folks will seem perfectly sober until they hit drink number 4, 6, whatever (it's different for everyone) and then they are suddenly falling-down shitfaced. I'm not talking about chugging or taking shots, just regular drinking. It's crazy. If they've already had a few before sitting at your bar, they can be absolutely hammered after just a beer or two. Then you have to figure out how they're getting home.

it maybe only a misdemeanor but its almost certain civil actions are waiting in the wings. Texas Supreme court already ruled on cases which tightened enforcement.
