there's no double jeopardy between with different jurisdictions prosecuting the same or similar underlying crime.
new york state only was an oddball because they had a specific state law that prevented state prosecutions after a similar federal case had been pursued, but they're getting rid of that.
other states routinely do and have done this.

passed court challenge. I follow a half dozen constitutional experts, including Laurence Tribe and others. They believe this is not likely to result in successful SCOTUS challenge.
