Sorry to be a wet blanket, but nothing I've seen in politics the last decade surprises me any longer, especially this tRumputin, rigged-in presidency or the way treasonous thuglican Senators are caping for their hog-in-chief.

(102,200 posts)Cases are heard by panels of three judges randomly assigned to the case so Garland is not necessarily going to hear the appeal (unless the decision is reviewed by the full court).

(42,684 posts)The appeal, which hasnt been filed yet, will be heard by a three judge panel of the DC circuit. There are 11 active judges on the court - 4 Obama appointees, two Trump appointees, 3 Clinton. One G W Bush and one GHW Bush. Plus there are 7senior status judges who sometimes serve on appellate panels 5 are Reagan appointees, one a GHW Bush and one a Carter appointee.
Garland is Chief Judge but that doesnt mean hell be on the panel that hears the appeal and even if he is there will be two other judges on that panel.

(6,280 posts).... and not doing proper research has come back to bite me in the rear. maybe I should just delete before everybody else wakes up points out my shortcoming. I guess I can take some comfort knowing that I have a lot of company in the twitterverse.

(6,974 posts)thuglicans will 99% of the time NOT recuse themselves when they should. Meanwhile, Dems recuse themselves from taking part in a judicial case where there may be a conflict of interest.

Then when they eventually lose they will REAPPEAL on the grounds Garland should have recused and we will start the clock all over again. This is all they have left. ENDLESS appeals until drumpf dies.

(9,426 posts)Garbage lingers until it rots. Sometimes it takes years and years. He wants to be KING forever. Anyone else with a diet such as his has many health problems. tRump just gets fatter. His neck has disappeared into his chest, he has to rotate his entire upper body to turn his head. He lumbers onto the stage like an arthritic senior citizen, applauding himself with each step. Vile excuse for a human being. I guess the "Be Best" campaign of his "vife" has no affect on him. As usual, he thinks the fault lies with EVERYONE but him.

(4,079 posts)Even with all of the "corrections" people have responded with, it's interesting news. Just the fact that Garland is the Chief on this panel is some sweet karma.
Also, I'm not so sure he will have to recuse. After all, Dump never did anything to him. Now, if it were Cocaine Turtle's tax returns...

(42,684 posts)The chief judge doesnt sit on every three judge panel. Assignments are largely random. If Garland ends up being assigned to the appeal there is no way he recused himself since there is no reason for him to do so
