As Donald Trump continues to fight against a congressional subpoena from House Democrats for financial records, he will now have to face the Obama-nominated judge Republicans refused to consider for the Supreme Court.
Merrick Garland is currently the chief judge at the D.C. Circuit Court of Appeals, where President Trumps legal battle will head next as the president's attorneys attempt to reverse the earlier court ruling in favor of Congress.
Garland was nominated to the Supreme Court by President Barack Obama in 2016 following the death of Associate Justice Antonin Scalia. But congressional Republicans stonewalled his nomination process until after the election, arguing that the incoming president should be the one to nominate a judge to the lifelong position.
After Trump was elected, he quickly nominated conservative Justice Neil Gorsuch to the high court. As a result, Garland resumed his position as chief judge of the nations most important federal appeals court, where he has served since 1997.

(42,602 posts)The odds that Garland will be one of the three judges that will hear the appeal are less than 50 percent. And if he is one, there is no way that he can be forced to recuse himself and I doubt that Trump's lawyers would even bother to try.

(6,414 posts)There are 11 Justices and cases are usually heard by a panel of 3 randomly assigned.
Moreover, it is common in the DC Circuit for one of the judges on a three judge panel to be chosen from the ranks of the seven senior status judges. So the chances of Garland being on the panel are probably less than 50 percent.

(62,444 posts)First off, the US Senate refused to convene hearings on his nomination, and that had nothing to do with Trump.
Secondly, is he idea here supposed to be that Judge Garland is motivated by personal vendettas instead of the law, and Im supposed to feel good about that childish belief?
