EXCLUSIVE: Obama Campaign Fails to File Delegate Slate for New Hampshire Primary

by Frank London · January 5, 2012

OOPS! – OBAMA CAMPAIGN FAILS TO FILE SLATE OF DELEGATES FOR NEW HAMPSHIRE PRIMARY

For obvious reasons, most news coverage of the 2012 New Hampshire presidential primaries focuses on the Republican contest. With rare exceptions, incumbent presidents seeking re-election enjoy a nearly insuperable advantage in their party’s nomination process.

So it’s business as usual in the Granite State, with only one candidate in the Democratic running. Or maybe not quite so usual — because that one candidate isn’t President Barack Obama.

Wait… what?

Section 655:51 of the New Hampshire Election Code required candidates for their party’s presidential nomination to submit slates of national convention delegates to the Secretary of State no later than November 18th, 2011. Only two Democrats did so, and one — Aldous C. Tyler — has since dropped out and endorsed the other, author and political historian Darcy Richardson.

At first blush, that means Obama appears to have surrendered New Hampshire’s national convention votes for his re-nomination.

Unlike the incumbent Democrat, fifteen of the thirty candidates running in New Hampshire’s crowded Republican primary on Tuesday, including all of the major GOP candidates, filed full or nearly complete slates of delegates and alternate delegates.

“I’m sure this was merely an oversight by President Obama’s re-election team,” says Richardson. “Like a bloated bureaucracy, in a billion-dollar campaign like President Obama’s — one that’s literally drenched in Wall Street money — it’s easy to imagine that the left hand doesn’t always know what the right hand is doing.”

Not that he’s complaining, mind you. Richardson, 56, of Jacksonville, Florida, launched his anti-war, anti-Wall-Street, pro-Occupy campaign last fall after his pleas to more well-known progressives to run — former Labor Secretary Robert Reich topped his list — fell on deaf ears.

“The President has very obviously forgotten what the Democratic Party stands for,” he says. “So I can’t say I’m really surprised that he forgot he needs the help of real flesh-and-blood Democrats to get re-elected as well. I haven’t.”

Richardson is on the Democratic primary ballot in several other states, including Missouri, Oklahoma, Louisiana and Texas and will be launching a petition drive for a spot on the Wisconsin ballot tomorrow. “I’m happy to take all the delegates he wants to leave on the table,” says the long-shot challenger. “We’ll be waiting to have a talk with him when he gets to Charlotte next September.”

http://www.battlegroundblog.com/2012/01/05/exclusive-obama-campaign-fails-to-file-delegate-slate-for-new-hampshire-primary/

So, without any delegates for Obama, we will again see a repeat of 1968 when challenger Sen. Eugene McCarthy beat the sitting Democratic President in delegates earned from the New Hampshire primary!!

Don't be a wingnut (right-wing or extreme-fringe).
Democratic Underground is an online community for politically liberal people who understand the importance of working within the system to elect more Democrats and fewer Republicans to all levels of political office. Teabaggers, Neo-cons, Dittoheads, Paulites, Freepers, Birthers, and right-wingers in general are not welcome here. Neither are certain extreme-fringe left-wingers, including advocates of violent political/social change, hard-line communists, terrorist-apologists, America-haters, kooks, crackpots, LaRouchies, and the like.

Vote for Democrats.
Winning elections is important — therefore, advocating in favor of Republican nominees or in favor of third-party spoiler candidates that could split the vote and throw an election to our conservative opponents is never permitted on Democratic Underground. But that does not mean that DU members are required to always be completely supportive of Democrats. During the ups-and-downs of politics and policy-making, it is perfectly normal to have mixed feelings about the Democratic officials we worked hard to help elect. When we are not in the heat of election season, members are permitted to post strong criticism or disappointment with our Democratic elected officials, or to express ambivalence about voting for them. In Democratic primaries, members may support whomever they choose. But when general election season begins, DU members must support Democratic nominees (EXCEPT in rare cases where were a non-Democrat is most likely to defeat the conservative alternative, or where there is no possibility of splitting the liberal vote and inadvertently throwing the election to the conservative alternative). For presidential contests, election season begins when both major-party nominees become clear. For non-presidential contests, election season begins on Labor Day. Everyone here on DU needs to work together to elect more Democrats and fewer Republicans to all levels of American government. If you are bashing, trashing, undermining, or depressing turnout for our candidates during election season, we'll assume you are rooting for the other side.

http://abcnews.go.com/blogs/politics/2012/01/look-ahead-an-early-look-at-new-hampshires-primary-ballot/

¬snip¬

The Democratic ballot is considerably shorter than the Republican ballot, but Democratic voters in New Hampshire wishing to take part in Tuesday’s primary do have a list of 13 names to check off aside from Barack Obama. The listed individuals span the ideological spectrum. Some are to the left of Obama, such as Darcy G. Richardson of Jacksonville, Fla., who bills himself as a “progressive Democrat” on his webpage and is running because he’s been “disappointed by President Obama’s abandonment of many of the progressive values that he articulated so eloquently.”

Others are to the president’s right, like Robert B. Jordan of Garden Grove, Calif., who is running on an “oil platform” which proposes lifting all restrictions on drilling in U.S. oil reserves, including the ANWAR and Prudhoe Bay regions in Alaska.

Qualifying for ballot access in New Hampshire is a relatively straightforward process. Candidates wishing to file for the first in the nation primary are required to submit a declaration of candidacy to the secretary of state’s office, along with a $1,000 filing fee. New Hampshire’s filing deadline was Oct. 28, 2011.

And 655:50 (not 51) says it's the 3rd Friday following the close of nominations - and the close was the 3rd Friday of November. Which shows that Darcy Richardson's blog is no better at reading the detailed rules than they claim the Obama campaign is.

At most, this would mean Obama NH delegates won't get to cast a vote at the convention.

So, without any delegates for Obama, we will again see a repeat of 1968 when challenger Sen. Eugene McCarthy beat the sitting Democratic President in delegates earned from the New Hampshire primary!!

Deadline for standing: 5pm, January 6th, 2012. Selected by 2 post-primary caucuses on Jan 14th. This would seem to make any list given to the Secretary of State irrelevant.

61. However, the NH Democratic Party has this to say about the delegate process:
Thu Jan 5, 2012, 09:45 PM
Jan 2012
District-level delegates and alternates shall be elected by post-primary caucus to slate
delegates on January 14th, 2012. Delegate Candidates shall be listed in alphabetical
order on a printed ballot; the starting letter shall be drawn by the State Party Chair.
Each person voting at a district level post-primary caucus shall sign a statement
certifying that (i) the person will be qualified to vote in the November 6, 2012
General Election and (ii) the person supports the presidential candidate whose district
level delegates are being chosen at the caucus.
...
An individual can qualify as a candidate for district-level delegate to the 2012
Democratic National Convention by filing a statement of candidacy designating
his or her presidential (or uncommitted) preference and a signed pledge of
support for the presidential candidate (including uncommitted status) with the
State Party by January 6, 2012 at 105 N. State St., Concord, New Hampshire.
(Rules 12.B & 14.F.)
...
Presidential Primary - Proportional Representation Plan (Rules 13.A., 13.B. & 13.D.) The New
Hampshire presidential primary election is a "binding" primary. Accordingly, delegate
positions shall be allocated so as to fairly reflect the expressed presidential (or
uncommitted) preference of the primary voters in each district. The National
Convention delegates selected at the district level shall be allocated in proportion to
the percentage of the primary vote won in that district by each preference, except that
preferences falling below a 15% threshold shall not be awarded any delegates.

http://libertycontrol.net/uploads/NHDP/NHDP2012DelegateSelectionPlan.pdf

So it looks like the Democratic delegates aren't selected through the direct NH process anyway. This may explain why, in 2008, the Secretary of State listed the Republican delegates, but not the Democratic ones: http://www.sos.nh.gov/presprim2008/

for Darcy Richardson.

eta:
Evidently he's playing by Republican rules. How awesome is that?

Candidates have to file the lists when they sign-up to run in the state’s first-in-the-nation presidential primary, along with the $1,000 filing fee and application.

Candidates are supposed to file 20 delegates and 20 alternate delegates, but few candidates filled out the entire slate. The slates are required by national Republican Party rules.
