it is. It's not anything I ever say. I don't have some process where I make up my mind, it kind of just works by gathering facts and listening to others, then I know shit.

It's a bad precedent - especially one that is coming from a former JAG who, presumably, would've defocated on the bed if one of the judges in one of his cases said the same thing.
