The crime is in his ASKING. When he said "I need a favor THOUGH," THAT was the crime. He asked for it. Asking for it is the abuse of power. The fact that he didn't get what he asked for doesn't wipe the slate clean.

If I try to rob a bank, but leave without getting any money, I'd still be guilty of attempted robbery.

If you try to bribe a police officer to get out of a traffic ticket, it's still a crime even if the officer doesn't take the bribe.

If a boss threatens to withhold a promotion unless his subordinate performs sexual favors, it's still sexual harassment even if the subordinate rejects him and ends up getting the promotion.

There are many other examples that could illustrate the point.
