(5,812 posts)...and you know the witness is smart, prepared and informed...IMO, WHY is OK.
HOWEVER on cross--I cannot think of a time I was inexperienced and dumb enough to give an adverse witness for the opposing side a free reign to say ANYTHING. And I mean ANYTHING. It does not matter if the WHY-response from the witness is factual, opinion, irrelevant, wrong, totally prejudicial, etc., the questioning atty is stuck with it. How does one object to a response when one's inquiry was WHY?

(10,749 posts)I remember a response in a Dear Abby column decades ago reminding her readers that half of all doctors graduated at the bottom of their class. I wonder if there's a website out there which will give you class rankings of your doctors and, given the OP, selected lawyers.

He could be in the very top of his class but those often are the ones who work for the State Bars and do research for the appellate bench. Those types are NOT the ones who can tap dance in a courtroom to any rhythm that is being played on direct or cross.

To an extent that is true. There is more to being competent than merely regurgitating facts one can not apply.

The impeachment inquiry of President Donald Trump moved in front of TV cameras Wednesday morning. Among those thrust into the spotlight during the public hearings was Steve Castor, a relatively low-profile lawyer with strong ties to the Philadelphia area.
Devin Nunes, the top Republican on the House Intelligence Committee, yielded much of his questioning time to Castor, who spent years interrogating Democrats as the chief lawyer of the House Oversight Committee when it was under Republican control.
Castor, a Philadelphia-area native, earned his bachelors degree at Pennsylvania State University and his MBA at Lehigh University before switching to law, gaining his degree from George Washington University. Prior to joining the Oversight Committee staff in 2005, Castor spent four years practicing commercial litigation in Philadelphia and Washington, according to a biography provided by House GOP staff.
For the last month, Castor has grilled witnesses as part of the closed-door hearings Democrats have held and made news when he openly said the alleged name of a whistle-blower during his questioning of Lt. Col. Alexander Vindman, a top Trump national security adviser.
