I disagree with him (as did Maya, Chris Hayes, and Claire) as I do likewise agree that the obstruction charges are an extension of the abuse of power. It would be hard to have obstruction without documented abuse of power, the reverse does not necessarily apply. Academically, Ari can argue the RW meme that the Dems had not exhausted all court avenues for documents and testimony, but in real application, that is bullshit.

I have heard a couple of commentators say they should have gone through the courts to enforce subpoenas. Ari said something similar. And I agree he is WRONG.

Congress is a COEQUAL branch of government. They have unfortunately given away much of their own inherent powers to the other two branches. Powers such as much of the war powers, and directly enforcing inherent contempt for defying subpoenas.

Yes, the congress has recently gone through the courts to enforce subpoenas, but they have the constitutional right to enforce them by sending out someone from the Sgt at Arms to pick up a subject with guns and cuffs, or to impeach a government official for defying subpoenas.

Including the President.
