Exactly this. Between that fucker McConnell talking about SCOTUS nominations in an election year, to Trump pardoning corrupt dicks left and right, to Barr literally destroying the justice system... to everything that is wrong with what the Republican party is doing to America, all of them need to either stop doing the wrong thing or sit the fuck down. Of course, none of these wankers would know the constitution if it jumped up and bit them on their lily white supremacist power hungry arses...

(9,895 posts)The Justice Department MUST be separated from the Executive Branch of a unitary executive government theory...they are servants to THE LAW, NOT THE POTUS and that MUST be codified and make explicitly clear.
The SCOTUS MUST be re-balanced, set to 11 justices. Also have justices nominated for only 12 year terms with the potential for recall or reinstatement after 12 years (or for cause) at the consent of the President AND Congress, in joint session of House AND Senate. Simple majority is not enough, but secret ballot votes would be required for each Justice on the question of "retain" or "replace". After 24 years, it is time for justices to retire - despite the fact that right now Ginsburg is a national treasure and credit to the country...it should never be necessary to stay on the bench to avoid replacement by a partisan administration and/or Senate.
The Executive Branch MUST be trimmed to exclude candidates that do not make their entire tax history public BEFORE being added to any ballot for consideration to the highest office. Impeachment for high crimes and misdemeanors or treason shall be brought by the House and tried by BOTH chambers and the SCOTUS if the two chambers split on a verdict. In any case, the number of witnesses, length of testimony or trial duration shall NOT be concluded until relevant witnesses, documents and subpoenas are executed and in the trial record. All other legislative and judicial proceedings before the Congress and SCOTUS shall suspend until the conclusion of the Impeachment Trial. No single set of "rules" shall allow witnesses to be coerced into silence nor allow presidents, senators, justices or judges to conspire to hide evidence during the proceedings.
The Executive Branch MUST be subject to the 25th Amendment to immediately suspend a President facing Impeachment (as they WILL be subject to criminal trials, the same as ANY OTHER CITIZEN during their terms) and install the Vice-President as acting President for the duration of the trial. IF/WHEN the president is acquitted, then the President shall be restored to office - if the President is convicted, the Vice-President immediately becomes the new President and a new Vice-President is to be confirmed by majority affirmation of the joint Congress.
The Legislative Branch MUST be brought to understand that the Senate rules do not supersede the right of the people to have their business from the House brought up for debate in the upper house. Any Majority leader who refuses to bring the people's business to the floor for naked partisan advantage shall be subject to impeachment and removal from the Senate by vote of the House of Representatives - their fellow Senators shall NOT sit in judgment of their own leadership's craven disregard for the rule of law any longer. Additionally, Senators beyond their 4th term in office would be required to serve reduced terms to ensure that entrenched power does not stagnate into corrupt power.
Our elections MUST be moved to a long weekend, the first in November - starting on Friday evening and proceeding through the following Monday evening at 9 PM local time. Polls are to be open during the period for a minimum of 12 hours and a maximum of 18 hours each day of the vote. Early voting MUST be made available for all states and all citizens for a period of time not to be less than 1 week prior to the general election and not to be longer than 14 days total time before the end of balloting. FULL PARTICIPATION should be compulsory for citizens age 18 and over, as registration shall be automatic and tied to Social Security Card Identity or other means of identification - once verified as a citizen of age, the person is registered to vote, period unless under criminal sentence to cause loss of the franchise. Failure to cast a ballot should result in a fine or misdemeanor charge requiring 4 hours of community service or suspension of a driver's license or other penalty not to exceed $1000 in cost or lost wages. It is beyond time to actually require citizens to actively participate in their democracy.
The electoral college MUST be banished in favor of direct apportionment of popular vote to candidates with the states determining if they shall be "winner takes all" or "apportioned by proportional accrual".
I am sure there are quite a few more, but these are necessary to restore a functioning government of LAWS not MEN, and without these steps to codify the reality of our governmental institutions, we are living in a quasi-dictatorship and that cannot be allowed for ANY party in office, period.

That's dangerous as heck. Who appoints them? Does it work like judges? Looking at the Supreme Court, I'm not sure that's a great idea.
A more reasoned alternative is to make the Attorney General and each US District Attorney directly elected -- for a term, just like other politicians.

When thinking of a government system, first imagine it fully set up and staffed by Donald Trump. If it looks dangerous, come up with a new system.
The second thing to remember is the solution to a government created problem is seldom more government. The reason the DOJ is so dangerous is pandering politicians have made every pet project (from drugs to improper union activities) a federal crime.
A lot of the problems with the DOJ can be traced back to poorly written laws and simply too many laws.

The biggest divide in the Democratic Party is not between left and center. Its between those who believe once Trump is gone things will go back to normal, and those who believe that our democracy is under a threat that goes beyond Trump. Everything flows from this debate. And finally, using our newfound political power to fix American politics to ensure we never have to deal with someone like Donald Trump ever again.
Defeating Trump is not enough; defeating Trumpism is the goal.

(2,690 posts)Last time there was secession it was a bit different. Remember, at that time there was no egregiously huge and expensive military ready to roll for the non-seceding side. So both the North and the South had to do some fast and furious recruiting and training.
But this time, Trump would have the military and he'd also have its loyalty, yes he would, to move against secession. As evil as the s.o.b. is, the constitution would be on his side -- and, ipso facto, so would the military that is, after all, sworn to defend it.
By the time the good guys (and don't leave out Maryland! We may have a Republican governor, but he's old school Republican and his Daddy was the first Republican in congress to turn against Nixon) were able to recruit and arm a military of their own, they'd be surrounded, out-manned and pretty much forced to give up.
And then the hangings would begin, probably in large stadia, Afghan style, with thousands of red-hatted fools cheering on the executions. Parallel to the executions would be the appropriation of lands, of businesses, of "treasonous citizens" by the Trump government.
If Trump steals the election, I think best we can do is lay low, do what we can to sabotage the machinery of his corrupt administration, and wait for him to die. That way, his successor might have a difficult time justifying cancelling the next presidential election -- not saying he (Pence again?) might not want to try. But if there were secession, there would not be another election in our lifetime and Trump would pretty much be able to name his own successor to the throne -- Don Jr., or Ivanka?
So, if Trump steals the election, I counsel patience, but with persistent protests that might, over time, erode the power of the Trump oligarchy.
Maybe neither we nor our children would live to see the restoration of America; but there would be a chance, at least a chance, that our grandchildren or great grandchildren might live in a Democratic-Republic once again. Secession would go up in flames and ensure the prolonged authoritarian dictatorship of the fascist corporate leeches.
