From @PeteWilliamsNBC: For the purpose of eliminating confusion, here are the facts. The authority to require businesses to close in a public health crisis is what is known as a police power, and it is reserved by the Constitution to the states, not to the federal
government.
Donald J. Trump ✔@realDonaldTrump
For the purpose of creating conflict and confusion, some in the Fake News Media are saying that it is the Governors decision to open up the states, not that of the President of the United States & the Federal Government. Let it be fully understood that this is incorrect....

(82,849 posts)The Tenth Amendment is only for the use of reactionary bigots. You're not supposed to be able to stop the Emperor Trump using the Tenth, because it belongs to his cohort. Tap, tap, no tapbacks.

(32,160 posts)why would Pete Williams, of all people, be quoted on something to do with Constitutional law? Police power is not reserved to either the states or the Executive branch. It has been used by Presidents many times in domestic situations. Just as one example Lincoln used police power to suspend civil rights of newspaper editors who disagreed with him. Some were jailed for periods.
The issue of whether a business can open or not is largely irrelevant. It does not matter what Trump says on that subject because if a governor wants a business to be closed it will remain closed, if for no other reason, it has local and state laws which bind it and state enforcers of those laws. Any business knows it will have to comply with a governor's orders or face big problems. That is just the real world.
