Since the picture is from the top of the Washington Monument, to which only NPS staff would have access, then, as noted in the photo credit it in the story to the National Park Service, the photograph it is a US government work which may be freely copied.

It wasnt obvious at first but you can swipe through a half dozen or so other views in the mall area.
The one at the Vietnam Memorial just destroyed me...I used to be able to look at photos of it; those days are gone I guess.

The massive record-breaking crowd that day was just taking a short 5-minute break to take in the Smithsonian museums. However, they all avoided the science museum for some unknown reason.
