Trump administration and Mitch McConnell hit with lawsuit over claims they denied stimulus checks to

citizens married to 'unauthorized' immigrants

The Trump administration is facing a lawsuit over the March $2.2 trillion COVID-19 stimulus package, facing claims it denied aid to married couples where one of the spouses is an "unauthorized" immigrant without a social security number.

The lawsuit was filed Friday in a federal court in Chicago by a man identified only by the pseudonym John Doe. It alleges the US government discriminated against Doe "based solely on whom he chose to marry," according to The Hill.

The lawsuit targets President Donald Trump, Acting Treasury Secretary Steve Mnuchin, and Senate Majority Leader Mitch McConnell — all Republicans.

Under the CARES Act, signed into law by Trump on March 27, individuals earning less than $75,000 annually are eligible to receive checks of $1,200 and up to $500 additional aid for their children under the age of 16. The money is distributed by the Internal Revenue Service.

NO stimulus checks. Also, small businesses are getting the shaft and well endowed businesses are getting the most money.

Shows what happens when you're out of town. The Senate and executive branch just completely take over.


I suspect that he will still get his money. To qualify he can do one of two things:

1. Wait until he files for 2020 and he and partner files separate returns. Suddenly the tax return only has on it valid ID numbers for those filing. If he has dependents that are mixed as to citizenship status, I think the law says that's fine--but he can only claim the ones with valid ID numbers.

2. Do the same thing for 2019. Don't file joint tax return. Reportedly if they're going to run a comparison between recipients and new 2019 tax filers after the deadline in July to spot those left to receive checks.

Since there are fairly simple ways of getting around the issue, I assume that a lower court will declare it's all unfair but a higher court will declare that it's legal.
