Skeptical judge could hold up Trump administration's bid to clear Flynn

WASHINGTON (Reuters) - The notoriously independent-minded federal judge who once said he was disgusted by the conduct of Michael Flynn could block the administration’s bid to drop criminal charges against the former adviser to President Donald Trump, legal experts said.

The Department of Justice on Thursday told U.S. District Judge Emmet Sullivan in Washington it wants to drop the case against Flynn, Trump’s former national security adviser, following a pressure campaign by the Republican president and his political allies.

While judges typically sign off on such motions, Sullivan could refuse and instead demand answers from the DOJ about who requested the sudden about-face, said Seth Waxman, a former federal prosecutor now at the law firm Dickinson Wright.

“If Judge Sullivan wanted to he could conduct an inquiry and start asking a lot of questions,” said Waxman.

I have been wondering about this. We don't yet know what Judge Sullivan will do, but he was royally pissed at Flynn when this began. He just might dig deeper. And Buttface Barr has no jurisdiction over him!

I have the feeling like he is not going to just quietly drop this. I'm sure he's as stunned as everybody else is.

The judge would ask huge amounts of very embarrassing questions.

Then he would allow the charges to be dropped without prejudice.

The same charges can then be refiled any time before March 2022.

The judge, who is enraged at the tactics being used in his courtroom, says NO, passes sentence on Flynn's guilty plea, and orders the bailiff to take Flynn into custody to begin serving his sentence.
That would be a wake up call. Flynn would probably be out on appeal within hours, but it would still be quite fun to watch the expression on that lying, conniving, traitor's face as they cuffed him and led him to the slammer.

Flynn could flip and nuke Trump's reelection bid.
So Flynn's saying "get me out of this or I'll nail you"

But Trump has a similar or worse problem with Roger Stone who has threatened to 'bring the house of cards down' if he's prosecuted.

So for optics, on a case that did not trouble Mueller, Rosenstein, Wray, Comey, Yates, Judge Sullivan, Flynn's original lawyers, etc, Barr spins up this charge withdrawal.

So that when it comes time to pardon Roger Stone, which Trump must if he wants any chance at reelection, it won't look like Trump is pardoning all his buddies in crime.

Caused some bad injuries. Like other victims of abuse, I dropped the charges.
However, the Judge wouldn’t drop them and the state proceeded with the case.
This makes sense to me. Glad to know that we don’t Justin close the books and go home.
