Democrats and other critics are seizing on the Department of Justice's (DOJ) decision to drop the case against former national security adviser Michael Flynn, arguing it shows how heavily politicized it has become under Attorney General William Barr.
Anger over the extraordinary move by Justice to drop charges even after it secured a guilty plea has created a new political storm around Barr, who had previously angered Democrats for his handling of former special counsel Robert Mueller's investigation.
The latest surprise move approved by Barr makes him even more of a political lightning rod figure in Washington.
"Attorney General Barr's politicization of justice knows no bounds," Speaker Nancy Pelosi (D-Calif.) said in a statement Thursday evening.

(51,584 posts)"DOJ dropped the case. It's not like there was a judicial decision made that he was innocent and the case can't be brought again for double jeopardy.
Basically DOJ is making a decision to not charge him. They don't have the power to absolve someone of a crime forever, just the power to not bring charges. A different DoJ could always decide that a crime was committed and charges should be brought.
Remember that his guilty plea to the one charge was a deal so that he, and his son, wouldn't be charged with other more serious crimes. Withdrawing the guilty plea will terminate that deal."

(42,687 posts)The government has asked that the criminal information against Fynn be dismissed "with prejudice." If the court was to do so, I believe double jeopardy would prevent subsequent prosecution based on charge of lying to the FBI about the contacts wth the Russian. But it wouldn't prevent prosecution on other facts, such as Flynn's failure to register as a foreign agent. And the judge doesn't have to dismiss with prejudice and it will be interesting to see what he does.

(7,517 posts)1. Judge Sullivan could tell the Department of Justice to go suck an egg and impose sentence on Flynn. Trump would then need to decide whether or not to pardon Flynn.
2. Judge Sullivan could decides to dismiss the case without prejudice. Trump would then need to decide whether or not to pardon Flynn to prevent future indictment.
3. Judge Sullivan could grant the motion to dismiss the case with prejudice. Trump would have no action to take.
