Let me save you some time and give you the excuses you'll likely hear up front, as all of them have already been used when it came to not going after Bush and Company:

"We don't need to be the ones to break tradition" (The "tradition" of not going after previous administrations)

Trump going after Obama *does* set the precedent.

investigated, charged and prosecuted after he leaves office. Not for all the "crimes" he committed while in office, but for things like possible money laundering, tax evasion and much worse. As Trump always says, "we'll see what happens."
