Just like you can't legally go into anyone's house and say things for which they might demand that you leave and expect them not to require your exit, you can't say things here that the owners and their designated agents, the MIRT and Alert Juries, evaluate and decide you can't post that.
#2. The 1st amendment does not extend to speech that endangers vulnerable others; hate speech is an example of this. It is illegal to "shout FIRE in a crowded, darkened theater, with few or unmarked exits" because that speech can result in MORE harm than people would otherwise expect in that situation.

(9,854 posts)And your #2 is the point that many people are trying to make about the guy who is promoting the movie that set off the protesters in the ME. But so many people here just gloss right over that and say that free speech has no limits. It obviously DOES have limits and I believe that a solid argument could be made that the movie violated them.

Not on a board that someone else owns. Each board has its own rules.
It is amazing how many people cannot grasp that concept.
Maybe if they thought of boards as little houses; surely they don't think they can go into another person's house and say anything they want to, without being asked to leave.....

(9,854 posts)But do you not think it is slightly odd that people who are SO righteous about making sure that nothing untoward gets said HERE, will so vociferously support limitless public free speech? I would think that would be a tenet you would hold dear both privately and publicly.

And quite honestly, I personally don't beleive in total free speech when it comes to publically self-admitted racists. I think they are so sick they should be thrown in jail for life or until they renounce racism.

(9,854 posts)Free speech DOES have limits, though. Many people are stating that the people who produced and circulated this movie are within their right of freedom of speech. I do not agree with that and since I have served on several DU juries lately, I know that there are many people who want the speech on this board to be a little less free. (yeah, I know this is private blah blah blah)
It's just something I noticed.

(16,191 posts)...the vast majority of "content" alerts are kicked back by the jury. I've adjudicated many alerts where someone was simply unhappy with someone elses opinion. In every case, the other jurors kicked the alert back and left the post alone.
Besides, there's a pretty fundamental difference between private speech and public speech. I would absolutely defend someones right to advocate an anti-Muslim opinion on a street corner. Offensive as it is, it's protected.
Advocate that same anti-Muslim argument in my living room and I'll throw your ass out the door before you can finish your sentence. You have a right to speak in public, but I don't have to listen, and I sure as hell don't have to allow it in my own home.
DU is Skinners living room. We're just here for the party.

(75,480 posts)being abused. Fortunately, the jury most of the time makes the right decision on whether a thread should be hid or not. It's a step better than the unrec, but it's still a nuisance.
