WASHINGTON — Jared Kushner, the president’s son-in-law and a senior White House adviser, refused on Tuesday to rule out postponing the presidential election in November, a comment that fed directly into Democratic concerns that President Trump might use the coronavirus crisis to delay or delegitimize the contest and one that contradicted Mr. Trump himself.

“I’m not sure I can commit one way or the other, but right now that’s the plan,” Mr. Kushner told Time magazine in response to a question about whether the election could be postponed because of the pandemic.

The opinion of a White House staff member has no bearing on when the election is held. Even the president himself does not have the authority to unilaterally postpone Election Day, which by law takes place the Tuesday after the first Monday in November.

Postponing or canceling the general election is highly unlikely. Here’s what that entails.

But Mr. Kushner’s comment raised alarms both because of the expansive power Mr. Trump has conferred on members of his family who serve in his administration and because it played into the worst anxieties of Mr. Trump’s detractors — that the president would begin to question the validity of the election if he feared he was going to lose.......................

If there were no election, there would be no speaker either since all House seats are up this election, too. So wouldn’t it fall to the president pro temp of the Senate?

Again this is all hypothetical because we know canceling the election can’t happen

If no election only those who still have time on their previously elected term would still be in office.Thay counts out all House members as well as all executive members . I think Grassley is current Senate Pro Tem.

potentially, the supreme court is not too impressed with constitutional expectations. Things have been so bizarre the last three and a half years that I don't expect that we have anything close to a normal election, or post election period. I'll certainly keep my fingers crossed.

...using Kushner to stir shit is disgusting.

You'd think they'd take an actual investigative stance here, given the NYT's resources, and given the huge gulf in information about what Kushner has actually been doing with taxpayer's money from his WH office, but they've chosen instead to gaslight us with this parasite.

Either the country is ready to open up the economy including holding elections or it is not and elections should include very large mail-in voting.

Either way, the elections can and should go ahead on November 3, 2020.

The election is a state power. The Constitution states when it will happen, but no power of postponement is granted to the federal government.

Therefore it is a state power by default.

States don’t even have to hold a vote for the presidency. The state legislatures can simply vote on a slate of electors to send to the Electoral College, without an election.

Has this ever happened in American history? Yes. Colorado in 1876.
