I usually litigate against federal prosecutors. But today - especially today - I'm proud to represent over 960 of them challenging DOJ's politically driven move to drop Michael Flynn's case. The law is clear: J. Sullivan must deny the motion if it's not "in the public interest."

When the president intervenes in an individual prosecution to influence it for corrupt or self-protective purposes, he violates not only that trust but also his oath of office and the Take Care Clause itself. He is not preserving, protecting and defending the Constitution to the best of his ability he is undermining it. Accordingly, however broad the presidents powers may be, one thing he absolutely cannot do is exempt or shield himself or his allies from applicable laws. This would, by definition not be taking care to faithfully execute the laws; it would be frustrating the execution of the law.
