Derek Chauvin was in plea deal talks before his arrest: report

Derek Chauvin, the Minneapolis police officer who was recorded kneeling on George Floyd’s neck until he died and ignited nationwide protests against racism, was reportedly in plea deal talks with the county attorney’s office before his May 29 arrest.

Hennepin County attorney’s office spokesperson Chuck Laszewski confirmed the negotiations took place, according to KMSP-TV. “Ultimately, those negotiations failed,” Laszewski said in a statement to the news station.

Unnamed sources said a deal on the table would have included state murder charges and federal civil rights charges, KMSP reported.

Chauvin knelt on the neck of Floyd, a 46-year-old black man, for nearly nine minutes on May 25. Both men once worked at the same Minneapolis night club, and a co-worker there told CBS News that Chauvin, who is white, had bumped heads with Floyd.

Per Minnesota's sentencing guidelines, the presumed sentence for someone with no prior criminal history for 2nd degree murder is 150 months, for 3rd degree murder is 86 months, and for 2nd degree manslaughter is 48 months. Judges are given discretion to 20% either way, so 120-180 months for Murder 2, 74-103 months for Murder 3, and 41-57 months for Manslaughter 2. Additionally, the sentencing guidelines also specifies that 2/3 of the sentence is to be imprisonment and the other 1/3 is supervised release.

Nobody, except the public, wants to take this to trial. For the prosecution, convicting cops is hard, and the risk of him getting off is too high. This guy has to go to jail or we'll have riots again.

For Chauvin's team, the risk of him spending 40 years in jail is there, and he'll likely agree to some reduced term given the right offer.

What's going to be important is what happened in the back of the cop car, where cameras couldn't see them. Did Floyd kick someone, did he threaten someone? That's what they'll say as a part of the defense, and they'll talk about how they were trying to keep the public safe until EMS arrived. It's bullshit, but given the confines and rules of a court of law, it'll have weight, and that carries risk for the prosecution.

Though any proffer Chauvin made cannot be used against him at trial.

For instance; if he told the prosecution that wanted to kill George Floyd because he was black and he hates black people, and was willing to say that as a part of a plea deal, those comments cannot be used by the prosecution as the deal wasn't agreed to and formalized. In some states, proffer comments can be used to impeach a witness if he were to testify to something else at trial, but I think the chances of Chauvin taking the stand are slim and none.

police certification and stay out of jail, in return for not seeking a job with the department they were in. It is bunk, he deserves prison for a long time.
