My speedometer read a few MPH high. So, I hit 68 or so and cruise control.
I'd be doing 65 half the time, 66 the other half.
Of course, I'm white. So it's probably ok for me to do it!

If "Minimum speed" wasn't posted, than 65 should be fine. As 70mph was the "Speed Limit" than nobody should be driving higher than the "limit".

I was responding to someone who said 20 mph under would be grounds to stop.

On a 70 mph highway, 20 mph under would be 50. If there is a posted minimum of between 40 & 50 (as is typical on most highways I've seen), EVEN 20 mph should not be grounds to stop.

I see them in most states. In most states it is 45.

It appears Virginia does not have a generic minimum - but if slower traffic would make things dangerous they have the ability to specify a minumum (with the implication that unless the minimum is posted you can travel at 1 mph if you want to).

There is no minimum speed in VA, unless it is determined there needs to be for a specific road. (That's what I just checked)

But the point still holds - whether it is posted or just in the law, if there is a minimum speed the "20 mph under" isn't a valid reason to stop unless that speed puts you below the minimum (or violates a different law - such as one that prohibits driving at a speed unsafe for the conditions).

Like the rule of thumb that police don't generally stop you if you're less than 5 over (unless you're black, and then the rule is aparently is stop if even close to the speed limit).

Umm . . . last I checked, the speed limit is a cap, not a floor.

That's harassment, to me.

Notice how the pig was feeling around to see if the driver knew his rights. Those questions were not pertinent to the stop, but more along the lines of an investigation which is where your rights kick in and you can be silent or ask if you are part of an investigation and if you are free to go.

Casual conversation my ass. That as an interrogation. A warning was just an insult and maybe the cop trying to justify the stop.

I was shocked that the fellow got out of his car to ask anything and it felt dangerous watching him. Luckily the cop was not in full murder mode at the time.

That "warning" was just to help him save face, but just made him look more like the imbecile he is.

I hope that guy followed up on that ridiculous stop.

And then the cop tried to suggest the driver was being unreasonable, for not wanting to participate in the cop's fishing expedition.

At least the cop helpfully identified himself and his department. Copies of this vid should be sent to all public officials in that jurisdiction, and to all the media outlets there, too.

can cite exact statute which does not allow 5 mph under speed limit (highly unlikely) there were no grounds whatsoever for stop - let alone all the questioning about his job, where hes going etc. Yeah there are sometimes minimum limits but generally these are about 20 mph less AND MUST BE POSTED.

I often find mmyself going 5-10 mph less than limit if its a twisty road or a I dont know the way. NEVER got stopped ever--- but then Im an old white lady and I guess driving too slow is what old ladies do (insert rolling eyeballs here)

you could clearly see the plate number and "connecticut", but the "constitution state" part was maybe 1/8th of an inch obscured. of course you could still easily read it.

apparently, that's enough to get you pulled over if they want to.


i've since removed the frames, which were only there because the dealer had put them on in the first place.


in the case of the 5 mph under excuse, this is just lazness on the part of the cop if nothing else. follow any driver for a few minutes and you'll find a more legitimate excuse to pull them over. failure to signal early enough, not driving in a perfectly straight line, too close to the car in front, etc.

or, of course, actually driving *over* the limit....

This is an example of why we need less police. They don't have anything better to do with their time than hassle people. For godsakes take the fucking money this fuckhead is paid and use it to help poor have places to live and food to eat.

Not the point. Pretext stop. Fishing expedition. 5mph under is not a citation.
But a random stop to "check it out" is common as dirt.

Incidentally .. this vid has been around for a while.

I was searched for drugs back in 1998. I was an enlisted Soldier getting off active duty and traveling to El Paso for undergrad registration. On the way back, cops saw me and pulled ahead of me for awhile while passenger side cop stared me down, then pulled behind me and pulled me over.

Gave them my license, rental agreement, and even my college registration materials.

They STILL searched my car for drugs.

Given I was in West Texas with two cops, complying seemed wiser than not. I was just lucky the previous owner wasn't a druggie.

They even searched the inside of the windshield.

After they were all done, it was ok, great, have a nice day. No ticket, no warning, no indication I was doing anything wrong.

They just saw a youngish black man in a rental car.

this was just a fishing expedition. with an invented reason for a stop. it's common practice.

Driving while black was the primary reason (with a veneer of 'overly cautious driver' as additional pretext). But it was entirely a "black guy .. check it out" stop.

this vid has been around for a bit (mid-Feb.?) .. so actually pre-escalation. you can find it, with more explanation and context, easily on google.

a car is kept later than expected it is reported stolen - holy crap. Last time I rented a car, an emergency required I keep it days longer.
I was finally able to contact and square it with the company - and all was good.

No - rental companies don't report overdue cars as stolen - they have all your info, and are used to unforeseen circumstances. Actually it makes money for them.

I had driven a rental from Illinois to Florida, and back for about 14 days. It took way longer to get back than I thought. Had the car 3 extra days, I brought it back in the morning after a good's night rest. No one from agency contacted me. In fact, I called them several times because I was sure they might be suspicious. Rental cars have tracking devices on them. They want it they will come and get it.

This happens a lot for folks who drive across states for work or even vacation.

Who decides what is "suspicious". Local cops see someone who looks different (black/brown) or out of state plates, they are hoping to win the lottery and catch someone with drugs. They have caught people who were traveling with lots of cash because they work in cash only businesses or don't trust banks. In those cases, they just seize the cash through civil asset forfeiture. Guns are great if you're white, but can get a POC killed.

Obviously it is not a crime to drive 5 under the limit. There is nothing in that warning. They just make up excuses. They also use busted tail light, head light, wipers, or whatever they can think of. But to a POC, a police pullover is the most dangerous few minutes of his life.

like crazy alot. There is no law against traveling 5 mph under the speed limit that is horse shit. I will say I travel at a few above all the time I take that route but I have seen people travel below and have traveled below involuntarily and have never seen someone pulled over for that.

That'd be hilarious if the circumstances behind shit like this weren't so tragic.
It's suspicious to drive 5 under the allowed limit? I was hoping that this was just a joke or fake but after the cop and police car were shown, it's likely not fake.

But during the conversation, you could see what Don Lemon alluded to, the constant need to restrain yourself.
No idea what this ahole wanted but he was fishing for something. The encounter might have been different had it not been recorded. A good example for a useless pos that isn't needed at all. Throw him out and save the money.

I know they do it at alcohol check roadblocks, but there were a number of court cases on that. And road blocks stop everyone. This is pulling over 1 car that is not violating any law; and then asking him where is he going, etc. We don't have to tell the cops where we're going or where we're coming from. I thought we were protected from random stops by the police.

This looks like an illegal stop to me.

When I lived in Houston a lady got a ticket for driving 65 on the autobahn down there. Everyone else was doing 80 or 90 and she was impeding the flow of traffic.

Here, troopers cannot ticket for that offense if above the minimum, or if the traffic is moving at unlawful spped.
In Illinois, one is under no obligation to go faster because others are violating the limit.
Obviously, Texas is different.

To answer the question NO!

In California, whatever the posted speed limit is, we have to at least
be driving within 10 miles per hour of that posted speed limit.
For example, if the speed limit says 70 mph, we have to drive at least 60 mph.

Driving more then 10 mph slower, becomes a road hazard.
So if we are driving less than 60 mph, yes that warrants a ticket.

If you have to drive less than 60 mph, you should drive on the shoulder
and have the hazard lights flashing, so that the vehicle can be moved
out of harms way.

In this video, this is pure harassment. I don't know what state this is but
most states have the same 10 mph slower law, on the books.
Driving 65 mph in a posted 70 mph zone, should be applauded, not warned.

I'm willing to bet this officer actually knows this law, but harassed anyway.

The act of pulling this man over for going 5 mph under the speed limit is morally reprehensible. When black people say, "legalize being black", they are speaking the literal truth that they have to live with every day. The man in the video, just as so many before him, did absolutely nothing wrong.

How is skin pigment color any different than hair color or height and weight? Everyone is different and unique but we all belong to the same species that originated in Africa, for fuck's sake. We are ALL descendants of Africa, the birth place of humanity. There is only one race: the human race. That should be the first thing every child on is taught.
