There's no reason he can't release prior years like he's supposed to according to custom.

A tricky move on his part, so technically he will have given 2 years of tax returns, 2011 being given at the last moment.
The silver lining is, this means his tax returns will once again be the main topic of conversation 3 weeks prior to the election and on everyone's minds when they go to the polls.
