Trump calls for Congress to take action against 'lowlifes' who burn American flag

President Trump late Tuesday called for Congress to take action against "lowlifes" who burn the American flag, seeking to put fresh pressure on lawmakers to pursue potential legislation.

"It is ashame [sic] that Congress doesn't do something about the lowlifes that burn the American Flag. It should be stopped, and now!" Trump tweeted.

The president made a similar pitch during a campaign rally in Tulsa, Okla., over the weekend, suggesting a minimum sentence of 1 year in prison for anyone who burns an American flag.

"We ought to come up with legislation that if you burn the American flag you go to jail for one year," Trump said, pointing to Oklahoma GOP Sens. Jim Inhofe and James Lankford, who were in the crowd.

A 5-4 1989 decision authored by William Brennan and joined by Kennedy and Scalia among others. It held that flag desecration is protected by the First Amendment.

Trump has no conception of the Constitution, or that it is the supreme law of the land that trumps (sorry) any statute to the contrary.

(a)
(1) Whoever knowingly mutilates, defaces, physically defiles, burns, maintains on the floor or ground, or tramples upon any flag of the United States shall be fined under this title or imprisoned for not more than one year, or both.
(2) This subsection does not prohibit any conduct consisting of the disposal of a flag when it has become worn or soiled.
(b) As used in this section, the term “flag of the United States” means any flag of the United States, or any part thereof, made of any substance, of any size, in a form that is commonly displayed.
(c) Nothing in this section shall be construed as indicating an intent on the part of Congress to deprive any State, territory, possession, or the Commonwealth of Puerto Rico of jurisdiction over any offense over which it would have jurisdiction in the absence of this section.
(d)
(1) An appeal may be taken directly to the Supreme Court of the United States from any interlocutory or final judgment, decree, or order issued by a United States district court ruling upon the constitutionality of subsection (a).
(2) The Supreme Court shall, if it has not previously ruled on the question, accept jurisdiction over the appeal and advance on the docket and expedite to the greatest extent possible.

In an opinion by Justice Brennan and decided along the same 5–4 lines as in Texas v. Johnson, the Court held that the federal government, like the states, cannot prosecute a person for desecration of a United States flag, because to do so would be inconsistent with the First Amendment. The Government conceded that desecration of the flag constitutes expressive conduct and enjoys the First Amendment's full protection. It is clear that the "Government's asserted interest" in protecting the "physical integrity" of a privately owned flag in order "to preserve the flag's status as a symbol of the Nation" and certain national ideals, is related to the suppression, and concerned with the content of free expression.

Doe what do the 2nd-Ammendment paranoid delusional folks think about that one.

Yes, I am presuming the capacity to think, but then, people who feel afraid and then gravitate to guns to feel safe and then, because they have guns feel frightened and paranoid that someone will take their guns away are not advocates of freedom, they are overwhelmed by their own, deep set fears and that makes their guns seem less safe for us all.

However, I digress, (and reserve that right). Now, their idol, Predator Grump is attacking the 1st-Ammendment, which can be said to be a vital and important aspect of democracy and that's why it is there. Free speech is absolutely vital to a free society, no doubt about it and we have seen many historical atrocities start with an attack on it and by way of overt suppression.

What do the MAGATs do with that one? Skip one and try to keep the other?

The Soviet Union and most East European countries have laws that require TWO to FOUR year prison sentences for flag desecration. Our namby pamby leader says only ONE year? I say, vote him out and put a REAL patriot in the White House, somebody who will enforce some real law and order.

...that he’s fixin’ to get stomped like a grape in November, and he’s taking the GOP down with him.

This country has problems. But to our ersatz leader, the only one that needs any attention is the non-problem of people burning flags.

Come January 20 when this nightmare is over, this entire maladministration needs locked up so they can’t do any more damage.
