(15,601 posts)A 2-1 decision by an appeals panel ordered Judge Sullivan to dismiss the case, but he has not done so yet. He can request an en banc appeal, in which the entire district court, every judge, gets to weigh in on this case.

(6,589 posts)I hope so, but on the other hand, if it is overturned & Flynn's guilty plea agreement stands, I 100% expect Trump to give him a blanket pardon, & Flynn would then probably never face consequences for anything he's done.
However, if the current case against him gets thrown out, he won't get pardoned & he can be prosecuted for everything (not just lying to the FBI, his plea agreement gets thrown out & prosecutors can go after him for everything) & instead of getting off scot-free with a pardon he might do real jail time.

(4,131 posts)That said, so you have any evidence folks have recently been sentenced to life in prison for smoking a joint? That seems an impossibility given the widespread legalization and decriminalization if marijuana but if I missed a recent case where this occurred Id like to know about it.

No judge ever ruled charges were untrue or guilty pleas were not voluntary.

(34,069 posts)A panel of the circuit court ordered Sullivan to dismiss the charges. I can't find anything that suggests he has complied, and there is at least the opportunity for an appeal to the full circuit before Sullivan is actually forced to dismiss the charges.
