In a wide-ranging interview with NPR on Thursday, Attorney General Bill Barr assumed responsibility for actions taken in the Roger Stone and Michael Flynn cases and the firing of Geoffrey Berman in the Southern District of New York. He also waved away the so-called whistleblower testimony of former Mueller prosecutor Aaron Zelinsky as double hearsay. What John said is hearsay. So is what Bill said. They are out of court statements used to prove the truth of the matter asserted. Hearsay within hearsay, or double hearsay.
Im not saying I agree with Barr, but hes not making up the rule.

(35,300 posts)But since hearsay is unreliable--the reason for the rule of evidence--basing Congressional formulation of policy on something that's unreliable seems in a sense worse than merely screwing up an individual's life because of confirmation bias.
They don't apply as rules. They should apply as simple common sense.
I've been dicked over by "well, the rules of evidence don't apply" sorts of logic, people hearing what somebody said somebody said, only to have the pile o' steamin' crap land on me. With "But I didn't say that" taken as confirmation, because otherwise why would I lie? (Yeah, that's the "logic".)
