Sounds like an exit is being planned. The guns don't have to be loaded to make it a crime. I don't know if the people staring at the wrong end of the barrel have to think it's loaded. It's a crime. It's brandishing, probably assault.

If the couple was poor and black, there would be no question in the prosecutor's mind.
