Justices Rule Against Trump on Tax Returns

The U.S. Supreme Court ruled a grand jury in New York City can see President Trump’s tax returns, though the decision was sent back to the lower courts since Trump can still appeal.

The bottom line: Trump does not have “categorical” immunity against a criminal subpoena, as his lawyers argued. Still Trump can argue the specifics of Vance’s subpoenas.

It was a 7 to 2 decision with Justices Neil Gorsuch and Brett Kavanaugh both voting to release Trump’s financial records.

CAVEATS:
SCOTUS votes 7-2 in favor of New York District Attorney in fight over Trump’s tax returns.

However, there are catches.

Case will go back to lower court to iron out limits of subpoena. Tax returns furnished to grand jury (and thus not public anyway).

Gist of the decision, which is 7-2 (with Alito and Thomas in dissent): lower courts did not take an adequate look at the special concerns involved when Congress subpoenas information about a president.

They need to try again.

FROM THE OPINION: "We agree that Presidents may challenge specific subpoenas as impeding their Article II functions." "And although we affirm while Justice Thomas would vacate, we agree that this case will be remanded to the District Court."

Something tells me if the Tulsa Kid were up in the polls, it would have gone the other way so he would be protected for four more years. With a Biden presidency looking more likely, they didn't want him to have any kind of court advantage.

I had been pointing out to conservative friends that according to Trump and Barr, they had been taking the position that if a president does it, it's not illegal so whatever Obamagate is about, it ultimately doesn't matter. Since Obama broke into Trump Towers personally looking for the Russian Pee Tape or whatever while president, it's fine. They twisted themselves up in pretzels trying to leave Trump as untouchable while allowing for prosecution of Obama. Guess it's moot now.

He has been screaming about Law and Order since the protests began. (no need for answers, we all know) But, thank God there is still be some law and order. Finally the long arm just stretched a little further.

And if he wins in November, no doubt with the help of his personal criminal lawyer Barr, and an eager lapdog Senate ready to change the laws for him, he'll find a way to skirt the whole thing.

My question is ....Why did this even have to be ruled on in the first place? How is it not assumed already that the President must abide by the laws of the country he or she is governing? IMO the courts were complicit in dragging this on until its too late to make a difference in November.
