Biden should serve notice his AG will be free to go after all of Trumps lawbreakers: conservativeIn her column for the Washington Post, conservative Jennifer Rubin said Democratic presidential nominee Joe Biden should let anyone who worked or is still working for Donald Trump and who has committed a crime including ignoring subpoenas issued by Congress know that they will be subject to prosecution should he win in November.
Using comments made by constitutional law scholar Laurence Tribe as a jumping-off point (Its well past time for Congress to lose its subpoena inhibitions, now that the Roberts court has unanimously rejected the administrations claims of absolute presidential immunity in a ringing reaffirmation of the principle that no executive official is above the law,) the never-Trumper said every official in the current administration who engaged in criminal conduct should face the music after the president is ousted.
There has to be a penalty, even a possibility of penalty, hanging over these officials heads, both to discourage continued wrongdoing and to hold accountable those who have cooperated with Trumps ongoing obstruction of Congress and willful violation of laws, she argued, adding that Biden should make that clear during the campaign while stating it will be up to whomever he nominates as his attorney general to decide which investigations need to be opened.
According to the columnist, there is a wealth of investigations that need to be opened looking at top Trump advisers like Secretary of State Mike Pompeo and Postmaster General Louis DeJoy.

(2,016 posts)The smartest move would be to ignore the question of criminal charges towards the current administration during the campaign so it does not become something that riles up their base. Then, go after them full force once Biden is in office.

(18,402 posts)The suggestion is not that Biden announce that he will instruct his attorney general to investigate and/or prosecute ... but rather, as the article states, that "it will be up to whomever he nominates as his attorney general to decide which investigations need to be opened." IOW, Biden is not in the picture; it will be wholly up to his AG.
Presidents do not, and should not, ask their attorney general to open investigations or prosecute. That is the vile modus operandi of the tinpot dictator in office now.
PS: I don't think he should go near any such statement during an election (or after). He should just choose a good AG.

There might be political considerations working against arresting the cheap thug himself, but in some ways, the minions are a greater problem. Without sergeants, a general is powerless, and people who serve a law-breaker need to understand they can be made to pay for their crimes in assisting him.
