A classmate of mine clerked for one of the great California Supreme Court judges known for being one of the country’s finest legal writers. My classmate early on submitted a proposed draft of an opinion, using the phrase res ipsa loquitor, meaning the thing speaks for itself. The sponge left in the stomach after surgery proves malpractice, the sponge speaks for itself, as an example. And got back the comment, if the damned thing speaks for itself how come it doesn’t speak English?
