Some Republicans at risk of losing their re-election bids may be very reluctant to have a vote, and if Mitch schedules one, may not vote to support a right wing nominee.

The answer is that under the Constitution, the number of Supreme Court Justices is not fixed, and Congress can change it by passing an act that is then signed by the President. Article III, Section 1, starts with a broad direction to Congress to establish the court system: “The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish.”

So it would require controlling the house, senate, and presidency but it can be done by with a simple majority if they change the senate rules.

I think it is more likely they will expand it to 11 but there is no limit, 11, 15, 31, 187 Supreme Court justices. The constitution doesn't specify the size of the court.

Article III, Section I states that "The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish." Although the Constitution establishes the Supreme Court, it permits Congress to decide how to organize it. (us courts.gov)

We were in an election year back in 2016. Will he adhere to his own logic? Doubtful.

So, yeas, pack the Supreme Court when we take back the WH and Senate in 2021.

McConnell wants to play dirty so we’ll have to as well.

Mitch is such a complete A-1 Dirtbag, so disingenuous. He threw it down when he turned down Merrick Garland because he said it was improper in the last year of a Presidential term...then said of course he would do that for Trump if the situation occurred.

So if we control it all let’s add two members.
