Vox: McConnell now says he'd hold SCOTUS hearings in an election year -- in a reversal of 2016

Senate Majority Leader Mitch McConnell now says he’d fill a Supreme Court seat in 2020 if one opens before the next presidential election — a revelation that indicates his refusal to confirm President Barack Obama’s nominee in 2016 was all about partisanship, not principle.

In 2016, McConnell said his refusal to even hold a hearing for Merrick Garland was rooted in the “Biden rule.” That rule resulted from an overinterpretation of remarks then-Sen. Joe Biden made on the Senate floor in June 1992, in the wake of the contentious Clarence Thomas hearings, about how he thought it would be best for the Senate to hold off on additional SCOTUS confirmation hearings until after that year’s presidential election.

“The Senate will continue to observe the ‘Biden rule’ so that the American people have a voice in this momentous decision” on who to name to the court, McConnell said on the Senate floor three years ago.

“Should a Supreme Court justice die next year, what will your position be on filling that spot?” an attendee asked. “Oh, we’d fill it,” McConnell replied with a smile.

Are there qualifications to be a Justice? Do you have to be a lawyer or attend law school to be a Supreme Court Justice?

The Constitution does not specify qualifications for Justices such as age, education, profession, or native-born citizenship. A Justice does not have to be a lawyer or a law school graduate, but all Justices have been trained in the law. Many of the 18th and 19th century Justices studied law under a mentor because there were few law schools in the country.

The last Justice to be appointed who did not attend any law school was James F. Byrnes (1941-1942). He did not graduate from high school and taught himself law, passing the bar at the age of 23.
Robert H. Jackson (1941-1954). While Jackson did not attend an undergraduate college, he did study law at Albany Law School in New York. At the time of his graduation, Jackson was only twenty years old and one of the requirements for a law degree was that students must be twenty-one years old. Thus rather than a law degree, Jackson was awarded with a "diploma of graduation." Twenty-nine years later, Albany Law School belatedly presented Jackson with a law degree noting his original graduating class of 1912.

needs to see that 24/7. Mitch sold out KY and sold out America. And BTW when the KY coal

McConnell already set the precedent with Merrick Garland, and it wasn't even less than 2 months to election then. We cannot allow them to ram some asshole through.

Tie it up in court, if nothing else.

needs to swoop in and "educate" them. If there's one thing we've learned over the past few decades (and recent years with Fat Nixon) -- Americans are HIGHLY susceptible to propaganda. Start propagandizing, Democratic Party! Something! Kentuckians love their version of Obamacare (KYnect?) but McConnell wants to destroy the ACA. They consider themselves military-loving patriots; well, McGrath served, McConnell didn't. Remind them that their state ranks near (at?) the bottom as far as poverty, education, health, etc. And I guarangoddamntee that Republicans are coming for Social Security -- perhaps with a stacked court they'll finally be able to kill off the program.

well, McGrath served and McConnell didn't. McConnell and Rand have been in office for waaaaay too long and Kentucky ranks at the fuggin' bottom WRT jobs, poverty, healthcare, etc. IN SPITE of all the blue tax dollar they take! My disgust levels are off the charts.
