(25,183 posts)And two weeks from this coming Monday, the 2020-2021 term of the SCOTUS starts, with a 5-3 Republicon majority. Any arguments scheduled from that day until the day that a successor is sworn into office will not have their outcome affected by the addition of the new Justice.

(25,183 posts)but clearly, Chief Justice Roberts has defended the ACA in prior opinions. But tied decisions have little value as precedent, under the doctrine of stare decisis, where what has been decided will prevail in future cases.

The credibility of the entire judicial branch is now in jeopardy because of McConnells packing with often unqualified judges.
