Make no mistake, Donald Trump calls the shots for the Republican Party.
Whatever decision he makes must be in the interest of Donald J Trump.
Uppermost in Donald's mind at this time is, what can help me win the election on November 3rd?
If he pushes thru his nominee now, there may be less incentive for some Republicans to vote for him in November? The only reason they voted for him the last time was solely for Supreme Court picks. He might actually lose votes if he chooses a Justice at this time.
Also, Trump understands that he is behind and he needs all the help he can get. Do Republicans want Joe Biden to pick the next Supreme Court Justice or do they want Donald Trump to make that choice?
When the political options are all weighed, Donald Trump will decide that it is in his best interest to leverage the Supreme Court pick to get more Republicans to the polls.
He can see it no other way, in my opinion.

(111,052 posts)What if there is a lame-duck Senate? It could be argued that the newly-appointed Justice would not be legitimate if appointed by Senators that were no longer in the Senate.
I could see problems there.

(7,510 posts)1. Push through confirmation before Nov 3 - Time is short, senators are campaigning, May be negative enough in particular Senate races that 51 senators won't go along with this option.
2. Push through confirmation in lame duck session between Nov 3 and Jan 1. Roughly 5 weeks after break weeks.
2.a. Trump has won and Republicans hold Senate. Probably hold off until next Congress.
2.b. Trump has won and Republicans lost control of Senate. Most likely case to push through nomination, because this is the last chance to change the Court.
2.c. Biden won, Republicans hold Senate. Less likely case to push through nomination. First two years of Biden administration would be remarkably contentious.
2.d. Biden has won and Republicans lost control of Senate. Probably hold off until next congress since the Senate minority will have to work with the new president and Senate majority.

I see little evidence of this. Besides, 6 is better than 5, if that's the only motivation.

Holding off on a SC pick would show he is capable of strategic long term thinking. A trait which any evidence of his having has never once appeared in anything he's ever done... Ever.

(12 posts)The logic you're applying to Trump supporters, is also applicable to Biden supporters. The chance at a SCOTUS seat will get more liberals to the polls, than the defeatist mentally that was all over this board as soon as RGB passed

(32,075 posts)Trump always makes things worse for Trump, and this has the makings of making it worse for the GOP, as well. Don't be surprised if they wind up fighting each other over this whole thing before anything gets done. There is no honor among thieves, and it could all very well backfire on them. Add to that the fact that Democrats are even more motivated to get out and vote now. They're going to be acting out of panic, and that never ends well.

(17,471 posts)Trump now has a chance choose the SC Justice that ends up deciding a contested election. The vote needed to stop the recounting of all of those "crooked" mailed in votes. The passing of RBG is a huge gift to Trump, he will waste the opportunity. McConnel will fast Trump's selection, and the Senate Republicans will vote for whatever swamp creature that will support all Right Wing issues.
When in the final days of WWII, Hitler, upon hearing of Roosevelt's death, was sure it was the miracle that would end up splitting the US and the Soviet Union and would keep Germany alive. I suspect that Trump is celebrating today for the same kinds of reasons. We can only hope it turns out the same.

We already have 3 Republicans who say they won't consider a nominee now. 50-50. One more and he can't get anyone thru.

(490 posts)Think about it - its a RW majority no matter what and a moderate pick makes him look reasonable and pragmatic a few weeks from the election. He would look above it all, the media would be fawning for a month over his bipartisanship and his cult believe whatever he tells them, so there would be no dissent there.
People have ridiculously short memories, so I guarantee such a move would help him claw back some of those on the soft-right whove been appalled by his behaviour and once again give life to the lie that maybe Trump isnt so bad.....

(31,011 posts)Given how much tRump has sewed confusion in voting and cried he was cheated if he loses, that's what he's aiming for. He's not a long term thinking guy. This election is all he's thinking about.
If the Dems can get in the WH and at least tie up the senate, their best chance is to expand the court, IMO. Nothing in the constitution to prevent it.
