What if Trump preemptively packs the SC court?
What if selects a replacement for Ginsburg, and then packs on or 3 more? Beating us to the punch.
Between now and December 31st?

12. This.
We Dems would be in a position to pack the court if Biden won, we took the Senate, kept the House, and in the Senate, nuked the filibuster.
The way you change the number of justices in SCOTUS is to pass a law. Both houses vote, and the POTUS signs it. |

might happen until it does.

13. Well lets just shut the forum down
Because preparing for the future is a huge part of this discussing board.

3. He has no reason to pack the court. The makeup of the court works for him now.

14. Sure he does
He knows the Dems will if he nominates someone.
He would do it to beat them to the punch. |

4. The size of the court is set by legislation. Changing it requires passing new legislation.
Unless the Democratic controlled House is going to pass a bill which gives Trump additional Supreme Court nominees that isn't something we need to worry about.

5. Do you ever see Mitch McConnell say, "we shouldn't do x because what will happen when the Dems take
power"?
You want to know why? Because he doesn't care. He just takes power. |

7. I hope democrats in office have finally learned
that they absolutely MUST do the same. If we get this chance and blow it, our democracy is probably finished and we'll never get the chance again.
Republicons will cement their hold on the judiciary, and manipulate districts and voting laws to make sure they never lose no matter what abuses and atrocities they commit. |

6. Simple.
President Biden issues an Executive Order that recalls and replaces all of Mitch's judges and revokes everything else the Trump maladministration has done.

But sometimes it's fun to open up the imagination to ways of fighting fire with fire.

10. If it were that easy, Trump would have done that to Obama's appointees
He has spent four years trying to erase everything Obama did.
If, if, if evidence emerges that Trump rigged the 2016 election and was, in fact, an illegitimate president, we would be in new territory through because that is an entirely different calculus. |
